End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Terrence McDonald, operating as CatchVault Co ("CatchVault," "we," "us," or "our") for the use of the CatchVault mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and Conditions and this Agreement.

2. Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App to violate any local, state, or federal laws, including fishing regulations
• Use automated systems or bots to access the App
• Attempt to gain unauthorized access to other users' accounts or data
• Upload content that infringes on the intellectual property rights of others
• Use the App to harass, threaten, or harm other users
• Submit false, misleading, or fraudulent catch data, tournament entries, or profile information

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years of age to create an account. You agree to provide accurate information and to keep it up to date. We reserve the right to suspend or terminate accounts that violate this Agreement.

4. User-Generated Content

You retain ownership of content you upload to CatchVault, including catch photos, comments, and messages ("User Content"). By uploading User Content, you grant CatchVault a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content for the purpose of operating, improving, and promoting the App. This license includes the right to include your User Content in anonymized or aggregated research, conservation, and fisheries datasets licensed to third-party organizations whose use is consistent with scientific, conservation, or sustainable fisheries management purposes — including scientific research institutions, government agencies, non-profit conservation organizations, sustainable-fisheries and habitat-offset programs, and private-industry research and development partners — in each case under a binding Data Use Agreement and subject to our Privacy Policy. We do not sell your User Content, in identifiable form, to advertisers, data brokers, or other third parties.

You are solely responsible for your User Content. We do not endorse or verify the accuracy of any User Content, including catch records, species identifications, or measurements.

We reserve the right to remove any User Content that violates this Agreement or is otherwise objectionable, at our sole discretion.

5. AI Features & Disclaimers

The App includes artificial intelligence features, including but not limited to:

• Fish species identification from photos
• Fish length and weight estimation
• An AI fishing assistant ("Finn") that provides fishing advice

These AI features are provided for informational and entertainment purposes only. AI-generated results, including species classifications, measurements, and fishing advice, are not guaranteed to be accurate. You should not rely solely on AI outputs for regulatory compliance, safety decisions, or any other critical purpose.

CatchVault is not responsible for any consequences arising from actions taken based on AI-generated information, including but not limited to misidentified species, incorrect measurements, or fishing advice that does not comply with local regulations.

6. Tournaments & Events

CatchVault provides a platform for users to create and participate in fishing tournaments. CatchVault is not a party to any tournament and does not guarantee the fairness, accuracy, or outcome of any event. Disputes between tournament participants are the responsibility of the participants and tournament organizers.

7. Intellectual Property

The App, including its design, code, AI models, branding, and all related intellectual property, is owned by CatchVault. This Agreement does not grant you any rights to our trademarks, logos, or other proprietary materials.

8. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://www.catchvault.co/privacy. By using the App, you consent to the collection and use of your data as described therein.

10. Third-Party Services

The App integrates with third-party services including Supabase, PostHog (product analytics), Anthropic (Claude API, powering the Finn assistant), OpenAI (powering the cloud fish-analysis fallback), Open-Meteo, Apple Sign-In, and Google Sign-In. Your use of these services is subject to their respective terms and privacy policies. CatchVault is not responsible for the availability or performance of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCHVAULT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Account Termination

You may delete your account at any time through the App's settings. We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App is revoked and your data may be deleted in accordance with our Privacy Policy.

14. Apple-Specific Terms

This Agreement is between you and CatchVault only, not with Apple Inc. ("Apple"). Apple has no obligation to provide maintenance, support, or warranty for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation. Apple is not responsible for any claims related to the App, including product liability, regulatory compliance, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it upon your acceptance.

15. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App after changes constitutes acceptance of the revised terms. We will make reasonable efforts to notify users of material changes.

16. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
